Plaintiff, a 24 year old delivery driver for a pharmacy was injured when he was rear-ended in his car making a delivery. Defendants argued that the plaintiff made a sudden stop without signaling. HKD got the court to find the defendant 100% liable for the accident.
Plaintiff sustained a herniated disc in his low back and ultimately underwent a lumbar fusion surgery. Defendants then argued that the accident was a minor “fender bender” and plaintiff’s back injury was congenital and pre-existing. The case went to trial in Westchester County where HKD attorney Andrea Borden obtained a jury award of $1,204,730.00 for the plaintiff.
